iHow it is calculated

A legal deadline is found from the start date, the length and the unit (days, weeks, months or years). The first day is not counted, and a deadline landing on a weekend or bank holiday rolls forward to the next working day:

deadline = start date + N × unit next working day

A 14-day deadline from Monday 5 January: counting starts the next day and it expires on 19 January; if that lands on a weekend or bank holiday it rolls to the next working day.

?Frequently asked questions

How is a legal deadline calculated?

Take the start date and add the period — days, weeks, months or years. The first day is not counted, so a period in days runs from the day after the triggering event. If the last day falls on a weekend or a day the court office is closed, the deadline rolls forward to the next working day.

Is the first day counted?

No. Under CPR rule 2.8 a period expressed in days is counted from the day after the event, and clear days exclude both the first and the last day. This tool starts the count on the day after the start date.

What happens if the deadline is a weekend or bank holiday?

It rolls forward to the next day the court office is open. A weekend or bank holiday cannot be the last day of the period.

How are short periods of 5 days or less counted?

For a period of 5 days or less, weekends and bank holidays are left out of the count entirely, so only working days are counted in between.

How do month and year deadlines work?

A period in months or years ends on the corresponding date in the later month or year — one month from the 10th ends on the 10th. If that date does not exist, such as the 31st in a short month, it ends on the last day of the month.
